Introduction

Welcome to SelfSmith: Personal AI Coaching. These Terms and Conditions ("Terms") govern your use of the SelfSmith application ("Application") and ​any related services provided by SYSOF-3 Inc. ("Company", "we", "us", or "our"). By accessing or using our Application, you agree to comply with and be ​bound by these Terms. If you do not agree with these Terms, you must not use the Application.

User Accounts

1. Account Creation:
   
1. To use certain features of the Application, you must register for an account
   
2. ("Account") and provide accurate and complete information.
   
3. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your Account.
   
4. You must immediately notify us of any unauthorized use of your Account.
   
2. Eligibility:
   
1. You must be at least 16 years old to use the Application.
   
2. By creating an Account, you represent and warrant that you meet the eligibility requirements and that the information you provide is accurate.
   

Use of the Application

1. Permitted Use:
   
1. The Application is intended for personal, non-commercial use only.
   
2. You agree to use the Application in compliance with all applicable laws and
   
3. regulations.
   
2. Prohibited Activities:
   
1. You agree not to engage in any of the following activities:
   
1. Using the Application for any illegal or unauthorized purpose.
   
2. Tampering with or circumventing the security features of the Application.
   
3. Introducing viruses, malware, or any other harmful code.
   
4. Collecting or harvesting any personally identifiable information from the Application.
   
5. Using the Application to infringe on the intellectual property rights of
   
6. others.
   
3. Content Ownership:
   
1. All content available on the Application, including text, graphics, logos, images, audio clips, video clips, data compilations, and software, is the ​property of SYSOF-3 Inc. or its content suppliers and is protected by intellectual property laws.
2. You are granted a limited, non-exclusive, non-transferable license to access and use the Application for personal, non-commercial purposes.

1. General Disclaimer:
   
1. The Application provides a dialogue related to your questioning.
2. The purposes are not intended as medical advice and a professional licensed coaching process.
3. You should consult any professional license coach to take responsibility for your decisions.
2. No Professional Advice:
   
1. The Application is an AI based, personal coaching app where it equips individuals with the ability to find their own answers through thought-​provoking questions and self-assessment.
2. Rather than providing the answers to users' questions, the Application helps users find the answer that aligns with their own values ​​and ​preferences.
3. The application is trained with sources including international coaching techniques to empower users to find out their own answers.

Payments and Subscriptions

1. Fees
   
1. Certain features of the Application may be available for a fee or subscription
2. ("Paid Services").
3. By selecting a Paid Service, you agree to pay the specified fees and any
4. applicable taxes.
2. Billing
   
1. Payment for Paid Services will be charged to your designated payment method.
2. Subscription fees will be billed on a recurring basis unless you cancel your
3. subscription before the next billing cycle.
3. Cancellation and Refunds
   
1. You may cancel your subscription at any time through the Application or your account settings in the mobile application market you use.
2. Refunds for Paid Services are subject to our Refund Policy

User Content

1. Ownership of User Content:
   
1. You retain ownership of any content you submit, post, or display on or through the Application (User Content).
2. By submitting User Content, you grant us a worldwide, non-exclusive,
3. royalty-free, transferable license to use, reproduce, distribute, prepare derivative works of, and display the User Content in connection with the ​Application.
2. Responsibility for User Content:
   
1. You are solely responsible for the User Content you submit.
2. You represent and warrant that you have all necessary rights to submit the User Content and that it does not infringe on any third-party rights.

Limitation of Liability

1. Disclaimer of Warranties:
   
1. The Application is provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, ​regarding the use or the results of this Application in terms of its correctness, accuracy, reliability, or otherwise.
2. We disclaim all warranties, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular ​purpose, and non-infringement.
2. Limitation of Liability:
   
1. In no event shall SYSOF-3 Inc., its affiliates, or their respective officers,
2. directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including, but not limited to, ​loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your use of or inability to use the Application; (ii) any unauthorized ​access to or use of our servers and/or any personal information stored therein; (iii) any interruption or cessation of transmission to or from the ​Application; (iv) any bugs, viruses, Trojan horses, or the like that may be transmitted to or through the Application by any third party; (v) any ​errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or ​otherwise made available through the Application; and/or (vi) the defamatory, offensive, or illegal conduct of any third party.
3. Our total liability to you for any claim arising out of or relating to these Terms or your use of the Application shall not exceed the amount paid by ​you, if any, for accessing the Application during the twelve (12) months immediately preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless SYSOF-3 Inc., its affiliates, and their respective officers, directors, employees, and agents from and ​against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from ​(i) your use of and access to the Application; (ii) your violation of any term of these Terms; (iii) your violation of any third-party right, including without ​limitation any copyright, property, or privacy right; or (iv) any claim that your User Content caused damage to a third party.

Governing Law

These Terms and any disputes arising out of or related to these Terms or the Application shall be governed by and construed in accordance with the ​laws of the Country, without regard to its conflict of law principles. You agree to submit to the personal and exclusive jurisdiction of the courts located ​within the Country to resolve any dispute or claim arising from these Terms.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least thirty (30) days' ​notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or ​use our Application after those revisions become effective, you agree to be bound by the revised terms.

Termination

We may terminate or suspend your Account and bar access to the Application immediately, without prior notice or liability, under our sole discretion, ​for any reason whatsoever and without limitation, including but not limited to a breach of the Terms. If you wish to terminate your Account, you may ​simply discontinue using the Application. All provisions of the Terms which by their nature should survive termination shall survive termination, ​including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Miscellaneous

Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Entire Agreement:

These Terms constitute the entire agreement between you and us regarding the use of the Application and supersede any prior agreements between ​you and us.

Waiver:

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
